Terms & ConditionsMJB Information Systems provides a large range of PC and IT Products & Services. MJB Information Systems reserves the right to suspend or cancel a customer's access to any or all services provided by MJB Information Systems when MJB Information Systems decides that the account has been inappropriately used or otherwise.
SERVER USE
Individual accounts are to be used by the primary owner only. Personal account holders are not permitted to resell, store or give away web-hosting services of their website to other parties. Web hosting services are defined as allowing a separate, third party to host content on the owner's web site. Exceptions to this on standard plans include ad banners, classified ads, and personal ads. Developer account may host client or multiple site and resell these facilities.
MJB Information Systems reserves the right to refuse service and /or access to its servers to anyone.
MJB Information Systems do not allow any of the following content to be stored on its servers:
Illegal Material - This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any Federal, State or Local regulation.
Adult Material - Includes all pornography, erotic images, or otherwise lewd or obscene content. The designation of "adult material" is left entirely to the discretion of MJB Information Systems.
Warez - Includes pirated software, ROMS, emulators, phreaking, hacking, password cracking. IP spoofing, etc., and encrypting of any of the above. Also includes any sites which provide "links to" or "how to" information about such material.
ABUSE POLICYMJB Information Systems takes service abuse matters extremely seriously. In the event that a client is found to be abusing our service, MJB Information Systems reserves the right to suspend or cancel their account immediately. This is an extreme measure taken in exceptional circumstances. Normal procdure would be to inform the client of a breach and ask for cessation of the activity. Failure to comply will result in account suspension.
Abuse includes specific breach of these Terms & Conditions, use of your account to send unsolicited bulk email ('Spam'), promotion of any site on our servers through the use of unsolicited email ('Spam').
MJB Information Systems reserves the right to reconsider the definition of Abuse at any time.
BANDWITH POLICYMJB Information Systems offers hosting plans with a pre-set bandwidth allowance on a rolling monthly basis. It is the clients resonsibility to monitor their own bandwidth and ensure that they have purchased additional bandwidth allowance to cover their useage. In the event of MJB Information Systems having to charge on an ad-hoc basis, due to insufficient allowance being purchased by the client, MJB Information Systems reserves the right to charge at the stated rates plus 50%
Total bandwidth useage, for the purposes of charges, is that shown in the client Control Panel and NOT on Web Statistics. Bandwidth allowance include FTP transfer and this is not shown by statistics software.
HIGH RESOURCE USER POLICYResources are defined as bandwidth and/or processor utilization.
MJB Information Systems may implement the following policy to its sole discretion:
When a website is found to be monopolising the resources available MJB Information Systems reserves the right to suspend that site immediately. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of MJB Information Systems servers and ensure adequate levels of performance for all clients. MJB Information Systems reserves the right to offer you a low-load or dedicated server alternative in such an instance. This may incur additional cost.
PAYMENT POLICIES
All Web Services accounts are set up on a prepay basis. Although MJB Information Systems reserves the right to change prices of accounts or services at any time all pricing is guaranteed for the period of prepayment. Payment for Web Services is due each anniversary year or month following the date the account was established. Clients will automatically be charged again at the end of their prepay period unless 30 days closure notification has already been given.
For tangible products and labour MJB Information Systems reserves the right to charge a deposit prior to undertaking your order. Products payment is strictly upn your receipt. Labour payment is within 7 days of invoice date. Any accounts overdue by more than 30 days will incur interest charges at 1.5% per month whilst the debt is still outstanding.
In situations where payment is not made within the specified time limit MJB Information Systems will immediately suspend all related facilities until the outstanding charge is processed successfully. In addition, MJB Information Systems reserves the right to suspend other services until the outstanding debt is cleared. The customer is responsible for all money owed on the account from the time it was established to the time that the customer sends a written cancellation request.
Bills, invoices or payment reminders may be sent by regular mail or by email, at our discretion, or any combination thereof. All such notices will indicate the period within which payment must be made to retain uninterrupted use of services.
All payments are based on our current, UK sterling, schedule of rates.
RETURNS POLICYMJB Information guarantess all new PC equipment for a period of 12 months and 2nd user equipment for 30 days from date of customer payment for such. In the event of faulty goods, these should be returned to us in good condition in the original packaging with your invoice/receipt. MJB Information Systems do not sell goods on a 'trial' basis or guarantee compatibility. MJB Information Systems may, at our discretion, accept such goods, subject to a 20% or £20 re-stocking fee, whichever is the lower.
In the event that goods are tested and found to be in working order and simply incompatible, and failing any specific instruction on required compatibility, MJB Information Systems reserves the right to charge a £20 testing fee to cover time incurred.
In addition to our warranty, there may be extended manufacturer warranties available on your equipment. It is the clients responsibility to register such warranties and retain all paperwork for such.
This does not affect your statutory rights in any way.
PAYMENT OPTIONSIn order to streamline our accounting procedures and keep costs down MJB Information Systems runs a limited number of payment options.
Credit / Debit Cards:
MJB Information Systems accepts all major credit/debit cards, via our online payment system. If you wish to pay a bill for a non-standard service price, then contact us and we will arrange an online account for your payment option. Payment via this service may require that you sign up with our payment gateway in order that they can verify your identity. This is a necessary measure to prevent fraud.
Cheque Payment:
This option is available to all customers in payment for their MJB Information Systems account. MJB Information Systems cannot guarantee that a service will be provided until after any received cheques have been cleared.
Bank Transfer:
MJB Informations will accept payments by Bank Transfer. Please contact your Account Manager for the relevant details. MJB Information Systems cannot guarantee that a service or products will be provided until payment has cleared. Please contact us with the details of your payment by Bank Transfer for expedient processing.
CANCELLATION AND REFUNDSMJB Information Systems reserves the right to cancel services at any time. In this event customers will be entitled to a pro rata refund based upon the remaining period of membership. If a customer contravenes MJB Information Systems' terms of service a refund will not be issued in the event of a cancellation.
Customers may cancel their account at any time. Any incentives offered to customers when opening the account will also be cancelled. Clients may be given the option to purchase services which were offered as start-up incentives in the result of a cancellation.
Fees charged on a prepay basis are non-refundable. In addition some accounts incur set-up fees, these charges are also non-refundable.
The client is responsible for all charges on their account for the period up to 30 days after receipt of closure notification.
UK domain renewals are now carried out under Nominet's Positive Renewal process. These will be carried out 30 days BEFORE expiry to ensure renewal of domains. Written cancellation notice must therefore be received 60 days PRIOR to expiry.
INDEMNIFICATIONClient agrees that it shall defend, indemnify, save and hold MJB Information Systems harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against MJB Information Systems, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Client agrees to defend, indemnify and hold harmless MJB Information Systems against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with MJB Information Systems' server; (2) any material supplied by client infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customer from MJB Information Systems' server.
DISCLAIMERMJB Information Systems will not be responsible for any damages your business may suffer. MJB Information Systems makes no warranties of any kind, expressed or implied for services we provide. MJB Information Systems disclaims any warranty or merchantability or fitness for a particular purpose. The includes loss of data resulting from delays, nondeliveries, wrong delivery, and any and all service interruptions caused by MJB Information Systems and its employees. MJB Information Systems reserves the right to revise its policies at any time.
